Terms of Service

Fundamental rules and agreements for service usage

Introduction

This Terms of Service ("Agreement") is entered into by and between Luftsocial and the user ("you" or "your") who accesses or uses the website, applications, browser extensions, and other services provided by Luftsocial (the "Service"). By using the Service, you agree to comply with these terms, and this Agreement governs your use of the Service.

Eligibility and Acceptance

You must be at least 18 years of age and legally capable of entering into binding contracts to use the Service. By registering for, accessing, or using the Service, you agree to the terms and conditions outlined in this Agreement.

If you do not agree with any part of this Agreement, you should not use or access the Service.

Account Registration and Security

To access certain features of the Service, you may be required to create an account. During account creation, you agree to provide accurate, current, and complete information, including:

  • Full name
  • Email address
  • Password
  • Phone number (optional)
  • Payment information (if applicable)

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. If you suspect any unauthorized access or activity, you must notify us immediately at info@luftsocial.com.

Subscription and Payment

The Service may include paid subscription options. By subscribing, you authorize Luftsocial to charge your payment method for applicable fees. All fees are non-refundable, except where required by law or as specified in this Agreement.

Subscription plans are auto-renewed unless you cancel your subscription. You may cancel your subscription through your account settings at any time.

User Conduct and Restrictions

You agree to use the Service only for lawful purposes. Prohibited activities include, but are not limited to:

  • Violating intellectual property rights
  • Engaging in any form of hacking, data mining, or unauthorized data access
  • Posting harmful or offensive content, including hate speech, pornography, and defamatory statements
  • Interfering with the functionality of the Service or using it to spread malware

You also agree not to use the Service for any activity that disrupts or damages the functionality of the Service or the platforms it connects to.

Limitation of Liability

Luftsocial is not liable for any indirect, incidental, or consequential damages arising out of your use or inability to use the Service. Our liability is limited to the amount paid by you for the Service in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold Luftsocial harmless from any claims, losses, or damages arising from your violation of these Terms or any misuse of the Service.

Termination of Service

We may suspend or terminate your account or access to the Service at our discretion, without prior notice, for reasons including, but not limited to, violation of these Terms.

Governing Law and Dispute Resolution

This Agreement is governed by the laws of Germany. Any disputes will be resolved in the competent courts located in Bremen, Germany.

Data Processing Agreement

Your privacy rights and our data handling practices

This Data Processing Agreement ("DPA") is an agreement between Luftsocial ("Data Processor") and its customers ("Data Controller") regarding the processing of Personal Data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

Scope of Data Processing

Luftsocial processes Personal Data only as instructed by the Data Controller. The Data Processor does not use Personal Data for its own purposes but only to provide the Service as outlined in the Terms of Service.

Data Security Measures

We implement appropriate technical and organizational measures to ensure the security of Personal Data, including encryption, access controls, and regular security assessments.

Sub-processors

We may engage third-party service providers (sub-processors) to assist with processing Personal Data. A list of sub-processors can be requested by the Data Controller at any time.

Data Subject Rights

We assist the Data Controller in responding to data subject rights requests, such as requests for access, rectification, erasure, or data portability. We will notify the Data Controller if we receive any such request directly.

Data Transfers

Personal Data may be transferred to countries outside the European Economic Area (EEA) or the United Kingdom (UK). In these cases, we ensure that the transfer complies with applicable laws, such as by using the Standard Contractual Clauses or other mechanisms to safeguard data protection.

Duration of Processing

We retain Personal Data only for as long as necessary to provide the Service or as required by law. Once the processing is no longer necessary, we will securely delete or anonymize the data.

Acceptable Use Policy

This Acceptable Use Policy ("Policy") outlines the acceptable use of the Luftsocial Service and is part of our Terms of Service. By using the Service, you agree to follow the rules outlined in this Policy.

Prohibited Conduct

You may not use the Service to:

  • Engage in any activity that violates laws or regulations
  • Upload or distribute harmful software, malware, or malicious code
  • Interfere with or disrupt the Service's functionality or the operation of connected social media accounts
  • Engage in cyberbullying, harassment, or abuse of any kind

Content Guidelines

You must not use the Service to post or transmit content that:

  • Is offensive, defamatory, obscene, or otherwise unlawful
  • Violates any intellectual property rights, including trademarks and copyrights
  • Discriminates against any individual or group on the basis of race, ethnicity, religion, gender, or other protected characteristics

Enforcement

Luftsocial reserves the right to monitor user activity and take appropriate action against violations of this Policy, including suspending or terminating user accounts and reporting the activity to authorities.

Refund Policy

Terms and conditions for refunds and returns

At Luftsocial, we aim to provide exceptional services. Our refund policy is designed to ensure fairness and transparency.

Eligibility for Refunds

  • Monthly Subscriptions: You are eligible for a full refund if you cancel within 7 days of the subscription date
  • Annual Subscriptions: You are eligible for a refund within 30 days of the subscription date. After this period, refunds are not provided for annual plans

Refund Process

To request a refund, please contact our support team at hello@luftsocial.com with your account details and reason for requesting the refund. Our team will review your request and process it according to the policy.

Luftsocial provides tools for social media management. By using the Service, you agree to the following terms:

Account Access and Permissions

When you connect your social media accounts to the Service, you grant Luftsocial permission to access, manage, and post to those accounts on your behalf. This may include:

  • Scheduling posts

Content Ownership

You retain ownership of all content posted through the Service. However, by using the Service, you grant Luftsocial a limited, non-exclusive, and revocable license to use, display, and distribute your content as necessary to provide the Service.

Social Media Platform Compliance

You are responsible for complying with the terms of service of each social media platform you connect to the Service. This includes adhering to the platform's content rules and data usage policies.
