Introduction

This Terms of Service ("Agreement") is entered into by and between Luftsocial and the user ("you" or "your") who accesses or uses Luftsocial App, our website, applications, browser extensions, and other services provided by Luftsocial (collectively, the "Service"). By using the Service, you agree to comply with these terms, and this Agreement governs your use of the Service.

When you authorize integrations with third-party platforms, permission prompts may identify our registrations by name — including threads app or Luftsocial app on Meta (Facebook) Developer Console and luftsocial App on TikTok for Developers — depending on the product and connection you enable.

Definitions

These definitions apply throughout these Terms and are used the same way in our Privacy Policy:

• "Service" — Luftsocial App, our website, other applications, browser extensions, and related services operated by Luftsocial.
• Luftsocial App — Our primary application name in these Terms and on our website. When you connect TikTok, OAuth consent may list luftsocial App exactly as registered with TikTok for Developers (same product).
• threads app — Our application name as registered with Meta Developer Console for Threads-related integrations.
• Luftsocial app — Our application name as registered with Meta Developer Console for additional Meta integrations.

Eligibility and Acceptance

You must be at least 16 years old to use this Service. By creating an account, you represent and warrant that:

• You are at least 16 years old
• You have the legal capacity to enter into these Terms
• If you are using the Service on behalf of an organization, you are authorized to bind that organization

If you do not agree with any part of this Agreement, you should not use or access the Service.

Account Registration and Security

To access certain features of the Service, you may be required to create an account. During account creation, you agree to provide accurate, current, and complete information, including:

• Full name
• Email address
• Password
• Phone number (optional)
• Payment information (if applicable)

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. If you suspect any unauthorized access or activity, you must notify us immediately at info@luftsocial.com.

Subscription and Payment

The Service may include paid subscription options. By subscribing, you authorize Luftsocial to charge your payment method for applicable fees. All fees are non-refundable, except where required by law or as specified in this Agreement.

Subscription plans are auto-renewed unless you cancel your subscription. You may cancel your subscription through your account settings at any time.

Acceptable Use

You agree to use the Service only for lawful purposes. You agree not to:

• Use the Service for unlawful or fraudulent purposes
• Violate any applicable laws or regulations
• Infringe intellectual property or privacy rights
• Interfere with or disrupt the Service or infrastructure
• Attempt unauthorized access to accounts, systems, or data
• Use the Service to distribute spam, malware, or harmful content

You also agree not to use the Service for any activity that disrupts or damages the functionality of the Service or the platforms it connects to.

Limitation of Liability

Luftsocial is not liable for any indirect, incidental, or consequential damages arising out of your use or inability to use the Service. Our liability is limited to the amount paid by you for the Service in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold Luftsocial harmless from any claims, losses, or damages arising from your violation of these Terms or any misuse of the Service.

Termination

We may suspend or terminate your account or access to the Service at our discretion, without prior notice, if you violate these Terms or for other administrative or security reasons.

Governing Law and Dispute Resolution

This Agreement is governed by the laws of Germany. Any disputes will be resolved in the competent courts located in Bremen, Germany.

• Analytics: Umami (cloud.umami.is) — loaded only if you consent; helps us understand usage

Scope of Data Processing

Luftsocial processes Personal Data only as instructed by the Data Controller. The Data Processor does not use Personal Data for its own purposes but only to provide the Service as outlined in the Terms of Service.

We implement appropriate technical and organizational measures to ensure the security of Personal Data, including encryption, access controls, and regular security assessments.

Sub-processors

We may engage third-party service providers (sub-processors) to assist with processing Personal Data. A list of sub-processors can be requested by the Data Controller at any time.

Data Subject Rights

We assist the Data Controller in responding to data subject rights requests, such as requests for access, rectification, erasure, or data portability. We will notify the Data Controller if we receive any such request directly.

Data Transfers

Personal Data may be transferred to countries outside the European Economic Area (EEA) or the United Kingdom (UK). In these cases, we ensure that the transfer complies with applicable laws, such as by using the Standard Contractual Clauses or other mechanisms to safeguard data protection.

Duration of Processing

We retain Personal Data only for as long as necessary to provide the Service or as required by law. Once the processing is no longer necessary, we will securely delete or anonymize the data.

Prohibited Conduct

You may not use the Service to:

Content Guidelines

Enforcement

Luftsocial reserves the right to monitor user activity and take appropriate action against violations of this Policy, including suspending or terminating user accounts and reporting the activity to authorities.

Eligibility for Refunds

• Monthly Subscriptions: You are eligible for a full refund if you cancel within 7 days of the subscription date
• Annual Subscriptions: You are eligible for a refund within 30 days of the subscription date. After this period, refunds are not provided for annual plans

To request a refund, please contact our support team at hello@luftsocial.com with your account details and reason for requesting the refund. Our team will review your request and process it according to the policy.
